Erica Drewry, LLC d/b/a Aligned Nutrition (the “Company”) is dedicated to protecting your personal information and informing you about how we use your information.  This privacy policy (the “Policy”) applies to your use of any of the services including the Company’s website https://alignednutrition.com/ (collectively “Site”). This Policy should be read in conjunction with the Terms of Participation and Use and the Company’s Disclaimer which are linked on the Company’s website listed above. We will only collect or use your personal information in accordance with the Policy herein or expressly agreed upon otherwise.

Confidentiality and Your Content and Participation

The Company respects your privacy and will not unnecessarily provide your information to anyone.  The structure of the communities and the Site, including social media platforms, require participation that may identify you and provide your personal information to others.  This may include sensitive information, due to the nature of the relationship with the Company, but the sharing of the information is limited by your personal participation.  If you have a separate relationship with the Company, or anyone connected with the Company, any confidentiality or privacy protections in that relationship will not be waived by your participation in the Site, unless you have provided that information.

If you interact with others on the Site, through communities, or on any related social medial accounts, such as participating in a group chat or a group online course, other users may have access to some of your data, including your name, profile picture, and your history of interaction with our website, such as prior comments or posts.  When you post, your posts may be viewed by others, and the Company may distribute your comments outside the website.

Any communications made by you in a public setting will not be held privileged or confidential and may be subject to viewing and distribution by third parties, even if you have a separate client relationship with the Company, or anyone with the Company. The Company owns any and all communications displayed on the Site or other media as allowed by United States law, and the Company will not give credit or pay royalties for unsolicited user-generated content.

The Company also maintains a right to republish any submission in whole or in part as reasonably necessary in the course your relationship with the Company.  You agree not to submit any content or communications that could be illegal or serve an unlawful purpose, including, but not limited to communications that are potentially libelous or maliciously false, obscene, abusive, negligent or otherwise harmful or inappropriate.

Information Collected

The Company may collect personally identifiable information (“PII”) and non-personally identifiable (“Non-PII”) information from you. Personally identifiable information is information that can be used to identify you personally. Non-personally identifiable information is information that must be combined with other information to identify you personally.

Personally Identifiable Information Collected

You are not required to provide any information just by visiting the Company’s Site.  However, in order to fully use the Company’s Site, it may collect PII such as your name, email, date of birth, telephone number, address and other contact information.  It may also collect your relevant payment or credit card information if you wish to pay for any services offered via the Site.

Although you are entering into an Agreement with the Company to disclose your information to us, the Company does use third party individuals and organizations to assist us, including contractors, web hosts, and others to allow you to access the Site.

The Company makes reasonable attempts to protect your information by using physical and electronic safeguards.  For this reason it may use security features to enhance the Site. However, as this is the Internet, it can make no guarantees as to the security or privacy of your information.  For this reason, the Company recommends that you use anti-virus software, routine credit checks, firewalls, and other precautions to protect yourself from security and privacy threats.

Your California Privacy Rights

The Company permits residents of the State of California to use its Site, and complies with the California Business and Professions Code §§ 22575-22579.  If you are a California resident you may request certain information regarding our disclosure of personal information to any third parties for their direct marketing purposes.  Various provisions throughout this Privacy Policy address requirements of the Californian privacy statutes. Although the Company does not disseminate your information to third parties without permission, you must presume that the Company collects electronic information from all visitors. Age Compliance

The Company intends to fully comply with American and international laws respecting children’s privacy including COPPA.  Therefore, it does not collect or process any information for any persons under the age of 18.  If you are under 18 and using our Site, please stop immediately and do not submit any information to us.   In the event that the Company has inadvertently collected any information from users under the age of 18 please contact the Company immediately.

International Transfer

Your information may be transferred to – and maintained on – computers located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction.  Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.  PII and Non-PII that is submitted to the Company will be collected, processed, stored, disclosed and disposed of in accordance with applicable U.S. law and this policy. If you are a non-U.S. member, you acknowledge and agree that the Company may collect and use your Information and disclose it to other entities outside your resident jurisdiction. In addition, such information may be stored on servers located outside your resident jurisdiction. U.S. law may not provide the degree of protection for information that is available in other countries.

Fair Information Practices:

In order to comply with Fair Information Practices the Company will take the following responsive action, should a data breach occur: The Company will notify you via email within 30 business days of any known breach.

CAN-SPAM Act of 2003:

The CAN-SPAM Act is a U.S. law which establishes rules for commercial email messages, gives you the right to stop certain commercial emails from being sent to you, and outlines certain penalties for commercial entities or persons who violate the law.

The Company collects your email address and name so we can:

• Send information, respond to inquiries, and/or other requests or questions.
• Process orders and to send information and updates pertaining to orders of a course, product, or service.
• Send you additional information related to your course, product and/or service.
• Market to our mailing list or continue to send emails to you after the original transaction has occurred.
• Email you a newsletter with free information and advertising certain Products, Services, and/or Courses we offer.

In accordance with the CAN-SPAM Act, we agree to the following:

• We will not use false or misleading subjects or email addresses.
• We will identify the email message as an advertisement in some reasonable way.
• We will include our business mailing address and/or physical address in our emails.
• We will monitor third-party email marketing services for compliance.

However, unsubscribing from one list or set of emails may not unsubscribe you from receiving ALL future emails from the Company.

If you are located within the European Union (“EU”), you are entitled to certain rights under the GDPR. You have the right to:

Severability/Waiver

If any provision of the Policy is held by to be invalid or unenforceable, the remaining provisions shall nevertheless continue in full force. The failure to enforce one or more of these parts of this Policy will not be deemed a waiver of that right or any further rights hereunder.

Survival 

The Policy survives termination of your relationship with the Company.
